Digital millennium copyright act
The Digital Millennium Copyright Act (DMCA) is a United States copyright law that implements two 1996 treaties of the World Intellectual Property Organization (WIPO). The DMCA dictates the take down of copyright-infringed (and non-copyrighted) content from a website which is publishing content in violation of copyright protection or content being used without permission or not in accordance to the content owner.
Although the DMCA is part of US Copyright law, a DMCA Takedown does not require the content to be copyrighted in order to process the takedown and for the content to be taken down by the website owner or online service provider.
DMCA Counter-Notification / Response
If you are the victim of an unlawful DMCA Notice, you can file a counter notice, which requires the person/business who filed against you to file a court case within a certain amount of time or the ISP must restore the allegedly infringing content. Filing a false DMCA Notice can also subject the filer to damages and possible criminal prosecution.
